CONTRACT OF RULES AND RESPONSIBILITY AND ATTENDANCE AGREEMENT
By attending this convention, you consent that you and all named and unnamed persons attending with you shall be bound to these terms and conditions, and you agree that you are authorized to provide such consent and release of liability. If you are under 18, you must have a parent/guardian accept these terms on your behalf.
This is a legal agreement between (a) you (an individual) and (b) this convention and its ownership that governs your attendance at the convention, and all activities related to the convention including those not officially organized by the convention or it's affiliates.
By selecting "I agree", entering the convention space or surrounding premises, or participating in any convention-sponsored or convention-related events, you agree to be bound by the terms of this agreement. If you do not accept these terms, your sole remedy is to not purchase an admission to attend the convention, and then to not attend our event.
You hereby assume all of the risks of participating in and/or volunteering in this activity, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
You certify that you have not been advised to not participate by a qualified medical professional.
You acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the convention, and that it will govern my actions and responsibilities at said activity or event.
In consideration of permitting you to participate in this event, you hereby take action for yourself, your executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) You WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for your death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Chrono Pop LLC, AnimeCon.org, the convention, and/or their respective directors, officers, employees, volunteers, owners, representatives, venues, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers;
(B) You INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by negligence or otherwise.
You acknowledge that the convention and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of the convention.
You acknowledge that this convention may include activities or featured events that involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of the event, and lack of hydration. These risks are not only inherent to participants, but are also present for volunteers.
We do not promise to analyze, enumerate, announce, or publish these risks. You are taking on the responsibility of understanding any risks involved, even if such risks may not be apparent.
You hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event.
You understand that at this event or related activities, you may be photographed. You agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers, and assigns.
You agree that information you provide, including Cellphone and Email, can be used for contacting you relating the convention and our affiliates, for either informational or marketing purposes. We may send you emails or text messages with information about the event, or marketing offers and/or marketing reminders.
The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. If any part of this agreement is deemed unenforceable, it shall be considered severable and the rest of this agreement shall remain in full force and effect.
You agree to and understand the convention's refund policy, which may not allow refunds of purchased tickets.
You agree to this agreement, and any addendums or terms posted on the convention's website.
What is the purpose of this contract?
Our event will typically include many sub-events. Some of these can include very interactive elements, such as (but not limited to) swordfighting, martial arts lessons or demonstrations, or roleplaying. These events and others could be dangerous. We do not promise to analyze, announce, or enumerate these risks. This contract protects the event, because you are accepting liability and risk of any and all dangers.
YOU CERTIFY THAT YOU HAVE READ THIS DOCUMENT, AND YOU FULLY UNDERSTAND ITS CONTENT. YOU ARE AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND YOU SIGN IT OF YOUR OWN FREE WILL.
